Many people come to the Sunshine Coast for a fresh start, so it can feel especially painful when a relationship ends here. If that's you, I'm sorry. There's a lot to work through — the children, the home, the business you may have built together — and it's natural to feel unsure where to begin. I'm Elisa Rothschild, principal at Fogarty Oliver Rothschild, and I've practised family law since 2012. I'm admitted in Victoria and to the High Court of Australia, which enables me to act in family law matters Australia-wide. Family law is federal: the Family Law Act 1975 (Cth) applies on the Sunshine Coast exactly as in Melbourne, for married and de facto couples alike. I work with Sunshine Coast clients by video, phone and email, and I handle every matter myself, explaining each step as we go.

Separation on the Sunshine Coast

Plenty of Sunshine Coast couples made a sea change together — sold up in a capital city, bought here, and perhaps started a small business or went self-employed. When the relationship ends, untangling those decisions takes care: who contributed what from the earlier sale, how the business is valued, and what each of you will realistically need going forward.

Families here often have grandparents nearby who are closely involved with the children, or have moved to the Coast to be near them. Children's relationships with grandparents and extended family are something the court can consider, and good parenting arrangements usually make room for them.

Making your agreement final

If you've agreed how to divide property or care for the children, consent orders make it final and enforceable. I draft the application and orders, check the financial disclosure, and go through every clause with you before you sign. They're filed online with a $205 court fee and decided on the papers, so there's no trip to court. Property orders must be just and equitable, and parenting orders must be in the children's best interests.

If you'd prefer a private arrangement, a Binding Financial Agreement under the Family Law Act can do a similar job without court approval — and couples sometimes make one before moving in together or marrying. Each of you needs independent legal advice, so I act for one of you only.

Divorce and time limits

Once you've been separated for 12 months you can apply for divorce, on your own or jointly, through the Commonwealth Courts Portal. The filing fee is $1,125, or $375 with a concession. Property is separate, and there are time limits: generally 12 months from the divorce taking effect, or two years from separation for de facto couples.

Applications are filed online, so agreed matters don't need anyone to attend. If a hearing is ever needed, the court allocates the registry, and I appear by video link where the court permits, or in person where required.

What it costs

I keep my Queensland fees lower than my Victorian fees, because I don't want cost to be a barrier when you're already under strain. A joint divorce application is $750 and a sole application $990. Consent orders are $990 for property only or parenting only, and $1,490 for both. A straightforward BFA starts from $1,490, with complex agreements ranging from $2,990 to $4,950. Court fees are extra. Your fee is confirmed in writing after the free 30-minute consultation, before any work starts.

Queensland generally exempts transfers of property between former partners made under family law orders or a BFA from transfer duty, subject to conditions — we check that for your property before anything is finalised.

If you're worried about safety

If you're in immediate danger, call 000. For confidential support, call 1800RESPECT (1800 737 732). Domestic violence protection orders are made under Queensland law by the Magistrates Court. Please tell me about any concerns at the start, because your safety and your children's safety come first.

Frequently asked questions — family law in Sunshine Coast

Can a Melbourne family lawyer act for me on the Sunshine Coast?+

Yes. Family law is federal, so the Family Law Act 1975 applies in Queensland exactly as in Victoria, and applications are filed online. I'm admitted in Victoria and to the High Court of Australia, which enables me to act in family law matters Australia-wide, and I work with Sunshine Coast clients by video and phone.

We sold our interstate home to buy here. Does that money count as mine?+

Money brought into the relationship is counted as a contribution, but it doesn't automatically come back to whoever contributed it. How much weight it carries depends on things like how long ago it was and what happened afterwards. It's worth talking through before you agree to a split.

How is a small business divided in a property settlement?+

A business is generally part of the property pool. It may need a valuation, and one of you may keep it while the other receives other assets. Full financial disclosure is essential, and I'll help you understand what to ask for.

Do grandparents have a say in parenting arrangements?+

The court can consider children's relationships with grandparents and other relatives, and grandparents can in some cases apply for orders themselves. Most families, though, simply build time with grandparents into the parenting arrangement.

How much does a divorce cost for Sunshine Coast clients?+

My fixed fee for Queensland clients is $750 for a joint application and $990 for a sole one, plus the $1,125 court filing fee ($375 with a concession). Your fee is confirmed in writing before any work starts.

Frequently asked

What other clients commonly ask

Do I need a lawyer to separate, or can I sort it out myself?

Many separations don't need a lawyer day-to-day, but you almost always benefit from one for the documents that lock things in — consent orders, a Binding Financial Agreement, a divorce application. Even a single free consultation usually saves time and avoids common traps.

How long does a typical family law matter take to resolve?

A cooperative settlement with consent orders typically takes 3-6 months end to end. A negotiated settlement without court runs 6-12 months. A contested final hearing in the FCFCA usually takes 18-24 months. Most matters settle well before that.

What's the difference between divorce, separation and property settlement?

Separation is when the relationship ends in practice. Divorce is the legal end of a marriage (12 months of separation required). Property settlement is how the asset pool gets divided — a completely separate legal process from divorce, often resolved by consent orders or a BFA.

Can family law matters be sorted out without going to court?

Yes — and most are. The vast majority of family law matters in Melbourne resolve through direct negotiation between lawyers, family dispute resolution (mediation), or by consent orders filed with the court without a contested hearing.

What is family dispute resolution (FDR) and is it mandatory?

FDR is a confidential mediation process led by an accredited practitioner. For parenting matters, you usually need to attempt FDR before applying for parenting orders (with limited exceptions for safety). For property matters, it's strongly encouraged but not strictly mandatory.

What is a de facto relationship and does the law treat it like a marriage?

Yes, broadly. For property and parenting purposes, de facto couples have the same rights under the Family Law Act as married couples once they've lived together for two years (or have a child together, or have made substantial contributions).
